Summary
The new Act provides for the appointment of a Territory Coordinator (TC), to facilitate the undertaking of significant projects and works, to provide for the designation of infrastructure coordination areas and Territory development areas, to expedite certain statutory processes and decisions and for related purposes.
General Outline
In particular, the new Act does the following:
- Establishes the statutory role of the TC and provides eligibility criteria for appointment to the role, grounds for termination, the functions and powers of the role, and powers to delegate the TC’s functions and powers.
- Grants the Minister the power to designate a significant project, declare an infrastructure coordination area (ICA) in relation to a significant project, and approve an infrastructure coordination plan (ICP) in relation to a significant project.
- Grants the Minister the power to appoint a program of works.
- Grants the Minister the power to designate a Territory development area (TDA), and to approve a proposed TDA plan in relation to the area.
- Establishes powers for the TC and Minister to give a prioritisation, progression-related, or decision request to a responsible entity of a statutory process or decision in a Scheduled law (a law listed in the Schedule to the Act or by regulation).
- Establishes the power for the TC and Minister to give a step-in notice to a responsible entity, informing them that the TC or Minister will step in to act as the decision maker for the specified statutory process or decision.
- Establishes the power for the Minister to give an exemption notice to modify or exclude the application of a Scheduled law on specific grounds.
- Establishes the power of the TC to give a condition variation notice to a responsible entity and a proponent, to modify or revoke a condition of a statutory approval under a Scheduled law.
