Green Hydrogen – Queensland

Across Australia, the Commonwealth as well as States and Territories, are considering what is required to facilitate the production of green hydrogen (and related products). In 2022, Energy Ministers agreed changes to the National Gas Law and National Energy Retail Law to bring these products within those frameworks. Queensland is concurrently reviewing its local legislation to enable the full value chain of hydrogen to be realised (production, transport, storage, distribution, use), and is currently consulting on proposed changes to its Gas Supply Act and Petroleum and Gas (Production and Safety) Act to bring hydrogen (and related products) within those Acts. The changes would see, amongst other things, hydrogen proponents being licensed and getting relevant land tenure rights under those Acts for the purpose of building and operating pipelines to transport hydrogen. This is an early step of many changes mooted by the Queensland government to support hydrogen production.
